Q1 What is the Racing Appeals Tribunal ("RAT")?
The RAT is an independent body established by the Queensland Government under section 150 of the Racing Act 2002 to handle appeals for the racing industry. Appeals may be lodged with the RAT against decisions to refuse or renew licences, or against disciplinary action or penalties imposed by stewards.
Q2 What is Commercial and Consumer Tribunal registry ("the registry")?
The registry provides administrative services for the RAT. Appeal hearings are held at the Registry at Level 11, 259 Queen Street, Brisbane.
Q3 When should I start the appeal?
Your appeal must be lodged with the registry within 14 DAYS of receiving notice of a penalty being imposed or of a decision being made.
Download an appeal form from the forms section or telephone (07) 3247 3304 and the Registry will send you the form by
post or facsimile.
Fill in the appeal form clearly and post or deliver it to the registry (see
contact details back page) together with the $256.10 prescribed fee and any
relevant documents. The fee may be paid through the post by cheque or money
order and by cash if in person.
If you wish to apply for a stay of the decision you must fill out the details in the Application for a Stay in accordance with section 170 of the Racing Act 2002. You will be notified of the outcome by telephone.
Q6 When will the appeal be heard?
The appeal will usually be heard within 28 days of receipt of your appeal by the registry.
Q7 How will I be notified of the hearing?
The registry will send a notice to the address you provide, stating the time,
date and place you have to attend. Hearing details will be published in the
Courier-Mail on the day of the hearing.
It is your responsibility to keep the registry advised of your current contact
details.
Q8 Where will the hearing be held?
Hearings for matters arising in South East Queensland will be conducted at the Registry at Level 11, 259 Queen Street, Brisbane. For other regions hearings will be held mostly by videoconference, but on occasions within the region in which the matter arises.
Q9 Can I summons a witness to the hearing?
A witness can be summonsed by the RAT on application by any party. The attendance of witnesses is within the discretion of the RAT. Application for attendance may be made to the Registry for decision by the RAT, giving the name and address of any person sought to be summonsed as a witness. If the RAT orders the attendance of the witness you must contact the Registry to make arrangements for service of the summons prior to the hearing
Q10 Can I have legal representation?
You may be represented by any person of your choosing including a lawyer if you so wish. Any costs involved in representation must be met by you.
Q11 What should I bring to the hearing?
You should attend the hearing at the time and place notified and bring all relevant documents, any evidence and your witnesses.
Q12 Who will conduct the hearing?
Your hearing may be conducted by one, two or three members of the RAT.
Unless otherwise ordered by the RAT, hearings are open to the public.
Q14 How long will the hearing take?
Most hearings take between 30 minutes and 3 hours. Complex appeals may take longer.
Q15 When will I know the outcome of the appeal?
The decision will either be handed down at the close of the hearing or published after the hearing. Written reasons for the decision will be sent to you.
